The History of Social Security Disability
There is a social contract in the United States that dates back to the 1930s. In addition to a safety-net retirement system given when a worker reaches normal retirement age, this social contract provides that workers will pay a portion of their income, usually by payroll deductions, towards Social Security Insurance. This contract provides that if you pay into the system over a minimum amount of time, our government will pay money to you based on the amount paid in by you if you become disabled before your eligibility for retirement.
While the system is designed to aid individuals who are dealing with the effects of a severe personal injury, it can be difficult to understand. The problem is defining which disabilities qualify for such payments and whether a particular claimant qualifies. At our firm, we help you understand this complex process. Our experienced attorneys are members of the National Organization of Social Security Claimant Representatives (NOSSCR). For more than 40 years, we have offered options to clients going through the process of filing for Social Security Disability.
Turning to a Legal Team
Experience teaches us that about 25% of those who appear to qualify to obtain Social Security benefits without the need for legal counsel. Another 30% to 40% who apply on their own are denied benefits, but they should have been approved. In these cases, applicants are denied because their documentation or presentation of their reasons for disability was not adequate.
We at Murphy & Dengler believe we can increase your likelihood of success at the initial administrative level. However, we feel our most value to a prospective client is before an administrative law judge where a federally appointed judge will make a determination of your medical condition as it relates to your vocational potential. Frequently at these hearings, expert evidence is produced, and expert witnesses are cross-examined. Most claimants find themselves at a disadvantage without qualified legal counsel.
Your Consultation
If you are thinking of applying for, or you have been recently denied Social Security benefits, please contact us to discuss your situation. Like most of our legal representation, we charge a contingency fee for such representation. This means we are not paid unless you are awarded back due benefits.
